Nowadays this traditional way is changed by international courts and these courts do not consider “state practice” as a main factor for recognition of international customary international law. Jurists opponent to this approach mention that using this way is illegal and can be regarded as “inventing customary international law by a court” and therefore is beyond the delineation of the judges duties. On the other hand, the advocators express this approach as an evolution in international law so that a court can find out an international customary law without paying too much attention to “state practices”. in international criminal law, using of the traditional way for recognizing the international customary law does not take place, especially in some tribunals such as ICTY because of security council resolutions. in addition, some international criminal tribunals have also diminished their resort to “state practice” for recognizing international customary law by considering “martens clause”, “human rights” and even decisions of political bodies of international organizations instead of using state practice. This approach has been used in second generation of international criminal tribunals for many times.}, keywords = {international customary law,State Practice,Invention of Customary Law,Transformation}, title_fa = {«تحول» در شناسایی عرف یا «اختراع» عرف؟ (توسل به موارد غیرقطعی عرفی در حقوق بین‌الملل کیفری)}, abstract_fa = {روش سنتی برای شناسایی عرف بین‌المللی مراجعه به «رویه دولت‌ها» به‌طور عام، در کنار «اعتقاد به الزامی بودن قاعده حقوقی» بوده است. امروزه دادگاه‌ها کمتر خود را مأخوذ به احراز کامل رویه دولت‌ها («رویه کلامی»، «رفتار فیزیکی عام دولت‌ها» و در پاره‌ای موارد «استنکاف دولت‌ها») برای تشخیص عرف بین‌المللی می‌دانند. این مسئله از نظر موافقین بیانگر وقوع «تحولی» مثبت در شناسایی قواعد عرفی بین‌المللی است ولی مخالفین، این رویکرد را به‌نوعی «اختراع» قواعد عرفی توسط دادگاه می‌دانند. درواقع واژه «اختراع» به‌نوعی دربردارنده مفهوم غیرقانونی بودن عمل است، چراکه دادگاه‌های بین‌المللی در معنای عام و دادرسین در معنای خاص اساساً چنین حق مصرّحی را ندارند. در حقوق کیفری بین‌المللی نیز درموارد زیر اعمال روش سنتی شناسایی عرف با تردید مواجه است: 1- در مقام تأسیس دادگاه‌های بین‌المللی کیفری، مثل ایجاد دادگاه بین‌المللی کیفری یوگسلاوی سابق با تصمیم شورای امنیت به‌واسطه فصل هفتم منشور ملل متحد؛ 2- در مقام صدور رأی توسط دادگاه‌های کیفری بین‌المللی، به این معنا که دادرسان نیز به تعبیری می‌توانند با استفاده از شرط مارتنس، توسل به قواعد حقوق بشر، استناد به تصمیمات مراجع اداری یا سیاسی بین‌المللی و ...، در غیاب «رویه دولت‌ها»، به شناسایی عرف بین‌المللی مبادرت کنند. در این نوشتار جایگاه این تحولات به‌خصوص درمورد دیوان بین‌المللی کیفری یوگسلاوی سابق موردبررسی قرار خواهد گرفت.}, keywords_fa = {"عرف بین المللی","رویه دولت ها"," اختراع قواعد عرفی",تحول "}, url = {https://jclc.sdil.ac.ir/article_100788.html}, eprint = {https://jclc.sdil.ac.ir/article_100788_e8398373652070f3d040f8cf967da3b2.pdf} }
