Structurally, two models are currently closed and open to criminal proceedings in different countries. In closed packages, an officer in the preliminary investigation stage (prosecution stage) is not in a position to exercise judicial remedies that conflicts with the right of individuals to privacy and their freedom (such as the inspection of homes and interim detention orders), and actions the above is available to an independent and impartial judiciary who has not been involved in conducting investigations and gathering grounds for crime. While in the open pattern, the investigating officer will decide on the above actions. The International Criminal Court model is a closed model because the prosecutor of the court in the above acts is under the supervision of an institution called the “Elementary Branch”, while the Iranian pattern has always been an open pattern. The Code of Criminal Procedure, approved in 2013, is also emphasized on the open model. The realization of fair trial standards as well as the global tendency towards a model of the package requires the creation of a closed model in Iran, and the International Criminal Court model is considered to be an appropriate criminal procedure design for Iran.}, keywords = {Closed Pattern,Open Pattern,Privacy,right to freedom,Initial Investigations,International Criminal Court}, title_fa = {بررسی تطبیقی نظارت قضایی در مرحله تحقیقات مقدماتی در دادرسی کیفری ایران و دیوان کیفری بین‌المللی}, abstract_fa = {یکی از جنبه‌های تشکیل‌دهنده دادرسی منصفانه در کنار ارکان «رعایت حقوق بشر» و «احترام به اصول اخلاقی»، وجود ساختار مناسب در فرایند آیین دادرسی کیفری است. به‌لحاظ ساختاری در‌حال‌ِحاضر دو الگوی بسته و باز بر دادرسی کیفری کشورهای مختلف حاکم است. در الگوی بسته، مقام متصدّی مرحله تحقیقات مقدماتی (دادستان یا بازپرس)، در انجام اقداماتی که جنبه قضایی داشته و با حق افراد به حریم خصوصی و آزادی ایشان در تعارض‫اند (مانند دستور تفتیش منازل و قرار بازداشت موقت)، اختیاری نداشته و اقدامات فوق در اختیار مقام قضایی مستقل و بی‌طرف دیگری قرار دارد که خود در انجام تحقیقات و جمع‌آوری دلایل مرتبط با جرم دخالتی نداشته است. درحالی‌که در الگوی باز، مقام متصدّی تحقیقات، خود درمورد اقدامات فوق تصمیم‌گیری می‌نماید. الگوی دیوان کیفری بین‌المللی از آن جهت که دادستان دیوان در اقدامات فوق، تحت نظارت نهادی با عنوان «شعبه مقدماتی» قرار دارد، الگوی بسته محسوب می‌شود. درحالی‌که الگوی ایرانی همواره الگوی باز بوده است. در قانون آیین دادرسی کیفری مصوب 1392 نیز الگوی باز پذیرفته شده است. به آن معنا که بازپرس در ایران، جز درموارد معدود، به‌تنهایی راجع به حق آزادی یا بازداشت افراد تصمیم‌گیری کرده و نهایتاً تصمیم او قابل‌اعتراض است. درواقع، دادرسی ایران، فاقد نهاد قضایی ناظر بر اقدامات بازپرس است. این ایراد زمانی پررنگ‌تر می‌شود که دادستان نیز در برخی مواقع ازجمله جرایم غیر ماده 302 قانون آیین دادرسی کیفری می‌تواند راجع به این حقوق افراد تصمیم‌گیری نماید. تحقق موازین دادرسی منصفانه و نیز تمایل جهانی به الگوی بسته مستلزم ایجاد الگوی بسته در ایران است و الگوی دیوان کیفری بین‌المللی در طراحی دادرسی کیفری مناسب برای ایران راهگشا محسوب میشود.}, keywords_fa = {الگوی بسته,الگوی باز,حریم خصوصی,حق آزادی,تحقیقات مقدماتی,دیوان کیفری بین‌المللی}, url = {https://jclc.sdil.ac.ir/article_110521.html}, eprint = {https://jclc.sdil.ac.ir/article_110521_37baf6fad1017d826c1d91d652775849.pdf} }
