For this reason, article 1 of convention against torture and other cruel, inhuman or degrading treatment or punishment (1984) provides meeting torture requires, beside act intention, special purpose such as obtaining information or confession. Some tribunals such as ICTY and ICTR considers this article as a customary rule and their interpretations form torture has been based upon this article, but the European court of human rights in some its judgments tend to treat torture as a material or absolute crime. The statute of ICC also in article 7 (2) (e) – in crimes against humanity- treat torture as a material crime. Although it seems this view is the most comprehensive form of prohibition of torture, statute, immediately, in article 8 (2) (a) (2) and (2)(c)(1), unlike article 7 without providing any certain definition of torture, classifies this crime as a war crime and also preparatory commission of statute believes that existence of special purpose is necessary for meeting torture as a war crimes. (سوء نیت خاص) را نیز برای تحقق جنایت شکنجه ضروری می‌داند. محاکمی مانند دادگاه کیفری بین‌المللی برای یوگسلاوی سابق و دادگاه کیفری بین‌المللی برای روآندا نیز ماده 1 کنوانسیون مذکور را عرفی می‌دانند و تفسیر آنها نیز از جرم شکنجه بر این ماده استوار شده است، اما دیوان اروپایی حقوق بشر در برخی از آراء خود تمایل دارد شکنجه را یک «جرم مادی یا مطلق»، بدون ضرورت سوء نیت خاص بداند. موضع اساسنامه دیوان کیفری بین‌المللی نیز در ماده 7(2)(ه‍‌) ـ در ذکر مصادیق جنایات علیه بشریت ـ دلالت بر مادی بودن جنایت شکنجه دارد. اگرچه به نظر می‌رسد این دیدگاه کامل‌ترین وجه ممنوعیت شکنجه است اما، اساسنامه بلافاصله در ماده 8(2) (الف)(2) و (2)(ج)(1) و در بیان مصادیق جنایات جنگی، بر خلاف ماده 7، شکنجه را بدون ارائه تعریف مشخص، به عنوان یک جنایت جنگی تلقی کرده است و کمیسیون مقدماتی اساسنامه دیوان نیز جنایت شکنجه در قالب جنایات جنگی را نیازمند سوء نیت خاص می‌داند. به نظر می‌رسد عدالت کیفری ایجاب می‌نماید سوء نیت خاص از عنصر معنوی جنایت شکنجه خارج گردد.}, keywords_fa = {شکنجه,عنصر معنوی,سوء نیت خاص,دیوان کیفری بین‌المللی}, url = {https://jclc.sdil.ac.ir/article_40882.html}, eprint = {https://jclc.sdil.ac.ir/article_40882_c8a2003abf14ed6c2493912702a80a61.pdf} }
