Prohibition of committing them has been recognized as jus cogens and all members of the international community have the duty to prevent it. The nature of this duty is known as erga omnes. In fact, international crimes violate the fundamental and human values which constitute the basis of the international community, so the international criminal law protects the community against the international crimes and mass violations of human rights. For this goal, by realizing the criminal responsibility for individuals, it prima facie regulates some obligations for persons not to commit those crimes and then addresses the states to cooperate to combat against the impunity of international crimes and to attempt to prosecute criminals by application of universal jurisdiction. Nowadays, humanization the concepts of the international crimes and relating them to the international conscience collective, changes the nature of some obligations of states as the non-reciprocal ones toward the international community, therefore non-reciprocity is realized in some field of international criminal law. In this article, non-reciprocal considerations in modern international criminal law will be discussed.}, keywords = {International Criminal Law,International Crimes,International Community,cooperation,universal jurisdiction}, title_fa = {جلوه‌های عدم تقابل در نظام حقوق بین‌الملل کیفری}, abstract_fa = {حقوق بین‌الملل کیفری، یکی از شاخه‌های جدید حقوق بین‌الملل است که با هدف تعقیب، محاکمه و مجازات مرتکبان جنایات بین‌المللی، در حمایت از ارزش‌های بنیادین جامعه بین‌المللی نقش مهمی ایفا می‌کند. مبنای شناسایی جنایات بین‌المللی، وجدان مشترک بشریت می‌باشد که در راستای انسانی شدن حقوق بین‌الملل متحول گردیده و دارای رابطه تنگاتنگی با قواعد آمره و تعهدات عام‌الشمول است. به این ترتیب، تحولاتی در برخی زمینه‌های حقوق بین‌الملل کیفری، محقق گردیده که رابطه مستقیمی با تعدیل و افول اصل تقابل در آن دارد. حقوق بین‌الملل کیفری، در وهله نخست با شناسایی مسؤولیت کیفری فردی، افراد انسانی را در جهت منع ارتکاب جرایم بین‌المللی مخاطب قرار می‌دهد، اما دولت‌ها نیز در آن واجد تعهداتی شناخته می‌شوند، به این ترتیب موضوع حقوق بین‌الملل کیفری، هم دولت‌ها و هم افراد به عنوان اعضایی از جامعه بین‌المللی هستند. از جمله تعهدات مهم دولت‌ها می‌توان به تعهد به همکاری اشاره نمود که مقابله با بی‌کیفری، بدون ایفای مؤثر و کارآمد آن از سوی دولت‌ها، ثمری نخواهد نداشت. اعمال اصل صلاحیت جهانی نیز از جمله ملاحظاتی است که در این راستا از سوی برخی دولت‌ها مورد اهتمام قرار گرفته است. با توجه به تحولات اخیر، تجلی عدم تقابل در ماهیت تعهدات دولت‌ها ناظر بر تعقیب، محاکمه و مجازات جنایات بین‌المللی از جمله دستاوردهای نفوذ و تأثیر ایده حقوق بشر در نظام حقوق بین‌الملل کیفری به شمار می‌رود. به بیان دیگر اکنون، فراتر از روابط متقابل و مبتنی بر منافع فردی دولت‌ها، سخن از تعهداتی است که بر عهده دولت‌ها و دیگر اعضای جامعه بین‌المللی در جهت مقابله با بی‌کیفری سنگینی می‌کند و البته این رویکرد از اهمیت عملکرد سازمان ملل متحد به نمایندگی از جامعه بین‌المللی نکاسته است. }, keywords_fa = {حقوق بین‌الملل کیفری,جرایم بین‌المللی,جامعه بین‌المللی,همکاری,صلاحیت جهانی}, url = {https://jclc.sdil.ac.ir/article_42398.html}, eprint = {https://jclc.sdil.ac.ir/article_42398_a1a03259a9daac64cb8e94b1a5c3517a.pdf} }
