Amongst them, it can be mentioned to changing method of commission of an offence, whether in a group or in an organized way. The organized offenders not only gain many financial advantages by their widespread activities, but also by their criminal activities, they attain power of effect on other economic, social and politic sections. Therefore, today one of the disturbances of administrators, who preserve security in society, is to resort to a set of social and situational preventive actions as well as punishing plans and equitably corrective training for guilties, until with making harder commission of offence process and its next steps, specifically preventing transmitting incomes of these crimes, we can prevent spreading them in societies.Therefore, some international documents related to these kinds of crimes such as Merida and Palermo conventions have introduced some actional and reactional activities and they have suggested some plans in order to effectively confront with transmitting incomes of these kinds of crimes at national and international levels.So, the state of Islamic Republic of Iran also has attempted to deduct preventive actions in some conventions such as Promoting Ministerial Health and Conflicting Corruption Convention, Conflicting Money Laundering Convention with due attention to international documents.}, keywords = {Organized crimes,Incomes of Crimes,Crimes,International Documents}, title_fa = {پیشگیری از انتقال عواید ناشی از جرایم سازمان‌یافته در حقوق کیفری ایران و اسناد بین‌المللی}, abstract_fa = {امروزه جرایم با توجه به شیوه‌های ارتکابِ آنها شکل نوینی به خود گرفته‌اند. از جملة این مواردِ تغییر نحوة ارتکابِ جرم، ارتکاب به صورت گروهی و سازمان‌دهی‌شده می‌باشد. مجرمان سازمان‌یافته با فعالیت‌های گستردة خود نه‌تنها منافع مالی زیادی را کسب می‌نمایند بلکه فعالیت مجرمانة آنها، قدرت اثربخشی بر سایر بخش‌های اقتصادی، اجتماعی و سیاسی را به آنان اعطاء می‌نماید. از این‌رو یکی از دغدغه‌های متولیانِ حفظِ امنیت در جامعه علاوه‌بر به‌کارگیری تدابیر سرکوبگرانه و بازپروری عادلانة بزهکاران، توسل به اقدامات پیشگیرانة وضعی و اجتماعی است تا با سخت‌تر نمودن فرایند ارتکاب و مراحل پس از آن، به ویژه جلوگیری از انتقال عواید ناشی از این جرایم از گسترش آنها در جوامع جلوگیری شود.از همین رو، بعضی از اسناد بین‌المللیِ مرتبط با این نوع جرایم از جمله کنوانسیون مریدا و پالرمو برخی اقدامات پیشگیرانة کنشی و واکنشی را طرح نموده‌اند و تدابیر و اقداماتی را برای مقابلة مؤثر با انتقال عواید ناشی از این نوع جرایم در سطح ملی و فراملی پیش‌بینی و ارائه کرده‌اند.بر همین اساس، دولت جمهوری اسلامی ایران نیز با الهام از راهکارهای ارائه‌شده در کنوانسیون‌های مزبور مبادرت به وضع اقدامات پیشگیرانه در برخی از قوانین از جمله قانون ارتقای سلامت نظام اداری و مبارزه با فساد و قانون مبارزه با پول‌شویی نموده است.}, keywords_fa = {جرایم سازمان‌یافته,عواید ناشی از جرم,جرم,اسناد بین‌المللی}, url = {https://jclc.sdil.ac.ir/article_81969.html}, eprint = {https://jclc.sdil.ac.ir/article_81969_19789d521d772e9ea5b6f38aebd176c4.pdf} }
