Journal Article 2019 11 09 Today, the right to counsel for the accused is recognized in the course of criminal proceedings in most legal systems. International law pursues this right along with other human rights. International law has focused on the right to counsel at two levels: First that, international courts, such as the International Criminal Court, apply these rules in their own rules of procedure and in their own practice; and Second that, states in their national legal systems don’t fail to grant this right to the accused. International law has established bodies to ensure human rights at the level of states. One of these bodies is the Human Rights Committee, which has formed according to the International Covenant on Civil and Political Rights (1966). This article intends to investigate the right to counsel in the Procedure of the Human Rights Committee. The outcome of this writing is that the Committee develops the right to counsel and interprets the right to defense set forth in the Covenant to the right to counsel with many of its requirements. امروزه حق برخورداری از وکیل برای متهمان در فرایند رسیدگی کیفری در غالب نظام‌های حقوقی به‌رسمیت شناخته می‌شود. نظام حقوق بین‌الملل نیز این حق را در کنار سایر حقوق بشر پیگیری می‌کند. توجه حقوق بین‌الملل به حق برخورداری از وکیل در دو سطح صورت گرفته است: نخست آنکه محاکم بین‌المللی همچون دیوان کیفری بین‌المللی این ضابطه را در قواعد و رویه خود مرعی دارند و دوم آنکه دولت‌ها در نظام‌های حقوقی ملّی خود از اعطای این حق به متهمان قصور نورزند. حقوق بین‌الملل به‌منظور تضمین این معیارهای حداقلی، نهادها و ارکانی تأسیس نموده است. یکی از این نهادها کمیته حقوق بشر است که به‌موجب میثاق بین‌المللی حقوق مدنی و سیاسی (1966) تشکیل شده است. مقاله حاضر به‌دنبال آن است که حق برخورداری از وکیل را در رویه کمیته حقوق بشر واکاوی نماید. برآمد این نوشتار آن است که کمیته در حوزة حق برخورداری از وکیل توسعه ایجاد نموده و از حق دفاع مندرج در میثاق به حق برخورداری از وکیل با بسیاری از ملزومات آن نائل می‌آید. https://jclc.sdil.ac.ir/article_110520_30e0200add83400ad4df26ecd901ab53.pdf
