This study, using a descriptive-analytical method, shows that the utilization of artificial intelligence deepfakes to distort audio and video in conflicts, as well as identical searches yielding different results based on individuals' laptop IP addresses, indicates a lack of impartiality on the part of social media platform designers. The findings indicate that the International Criminal Court has increased its reliance on new technologies to identify evidence obtained from new technologies; but at the same time, in some cases, it has disregarded digital evidence presented, such as issuing arrest warrants for Hamas leaders following the October 7, 2023 conflict. In 2023, by implementing platforms for uploading and analyzing digital evidence, the Court acted to counter fake data and algorithmic biases; just as the German Federal Office for Information Security, to preserve and authenticate digital evidence, launched two systems for intrusion detection and prevention, the adoption of such measures in Iranian criminal law and the current system of the ICC can, in turn, be a step towards appropriate judicial decision-making, ensuring judicial integrity, enhanced restorative justice, and democratic criminal adjudication<span style="font-size: 12.0pt; mso-ascii-font-family: 'Times New Roman'; mso-ascii-theme-font: major-bidi; mso-hansi-font-family: 'Times New Roman'; mso-hansi-theme-font: major-bidi; mso-bidi-font-family: 'Times New Roman'; mso-bidi-theme-font: major-bidi;">. درعصر کنونی، فناوری‌های نوظهور، قدرت محاسباتی و ماهیت شواهد مرتبط با جنایات بین‌‌المللی را تغییر داده است؛ امری که ضرورت انجام پژوهش حاضر را نشان می‌دهد؛ در این میان، پرسش اصلی این است که فناوری‌‌های جدید در پیگیری‌‌ جنایات ارتکابی در سطح بین‌المللی چه تأثیری داشته و چه چالش‌هایی را ممکن است ایجاد کنند؟ نوشتار حاضر با روش توصیفی ـ تحلیلی نشان می‌‌دهد که بهره‌‌گیری از هوش مصنوعی و فناوری دیپ‌‌فیک در تحریف صدا و ویدئو در درگیری‌ها و نیز انجام جست‌وجوهای مشابه با توجه به IP لپ‌‌تاپ اشخاص، نتایج متفاوتی را رقم می‌‌زند؛ امری که بیانگر بی‌‌طرف نبودن طراحان پلتفرم‌های رسانه‌‌های اجتماعی است. یافته‌‌ها حاکی است که دیوان کیفری بین‌المللی، اقدام به افزایش اتکا به فناوری‌های جدید برای شناسایی شواهد به‌‌دست آمده از تکنولوژی‌‌های کرده ‌‌است؛ اما در عین حال، در برخی موارد نسبت به ادله دیجیتال ارائه شده بی‌اعتنا بوده، مانند صدور قرار بازداشت برای رهبران حماس در درگیری 7 اکتبر 2023. دیوان کیفری در سال 2023 با اجراکردن پلتفرم‌‌هایی برای بارگذاری و تحلیل شواهد دیجیتال، اقدام به مقابله با داده‌‌های جعلی و سوگیری‌‌های الگوریتمی کرد؛ همان‌‌گونه که اداره فدرال امنیت اطلاعات آلمان، برای حفظ و راستی‌‌آزمایی ادله دیجیتال، دو سامانه جهت تشخیص و پیشگیری از نفوذ راه‌اندازی کرده است. در حقوق کیفری ایران و نظام فعلی دیوان کیفری بین‌‌المللی، اتخاذ چنین تمهیداتی می‌تواند به نوبه خود گامی مؤثر در مسیر تصمیم‌گیری قضایی شایسته، ارتقای عدالت ترمیمی و تحقق دادرسی کیفری دموکراتیک باشد.
