A Jurisprudential Feasibility Study of the Tashhir (Public Shaming) Punishment for White-Collar Criminals Based on Differentiated Criminal Policy

Abstract
Criminal policymakers, in exceptional cases due to the specific characteristics of a crime or an offender, enact rules distinct from the general penal system. A prominent example is white-collar criminals, who often hold high social status. In this regard, this article employs a descriptive-analytical method to examine and analyze the punishment of tashhir (public exposure/shaming) for white-collar criminals, based on the framework of a differentiated criminal policy. It first addresses the theoretical foundations and definitions of differentiated criminal policy, white-collar crime, and the tashhir punishment, drawing on library resources. Subsequently, it presents the evidence and proofs (adillah) for tashhir within jurisprudential domains. Finally, it analyzes the jurisprudential basis for applying tashhir to white-collar criminals using rational (‘aqli) and chronicled (naqli) proofs. Among the key findings is that the tashhir punishment for white-collar criminals is, firstly, justified from the perspective of rational proof, through the concomitance (talāzum) between the ruling of reason and the ruling of religious law (shar’) and by the observance of public interest (maslahat-e jame’eh). Secondly, it is justified through chronicled proofs, including the generality (‘umūm) and absoluteness (itlāq) of the cause stated in prophetic narrations (“and they are paraded so that they may be recognized and not return [to crime]”), as well as the practical conduct (sirah ‘amaliyyah) of Imam Ali. Therefore, tashhir is established as a religiously lawful (mashru’) and entirely necessary measure.
