A criticism on the punishment of reluctance in murder in law and jurisprudence based on the cause of stronger than doer

Reluctance in murder is one of the cases whose punishment in Iranian law is in conflict with the logic of criminal law and custom, while the legislator accepts reluctance in the inner self and punishes the reluctance as a reason for punishment, but does not accept the reluctance in the soul and deems the reluctance to be retribution. While there is no basic difference in the effect of reluctance on the self and on the self, also custom does not consider the punishment of abomination to be based on justice, therefore one must look for a basis to comply with the Shariah requirements of the punishment on the one hand and with the logic of criminal and customary law on the other hand. It is consistent and the cause of the aqwa from the steward can give a complete basis for the punishment in the conditions of involuntary murder. Because the legislator accepts the effect of reluctance in the inner self, he must also accept it in the ego, in fact, the mechanism of the effect of reluctance works in the same way in both situations. Also, in the condition of reluctance, there is no social blameworthiness, and the society considers the murderer to be excused and retribution in the condition of reluctance. In this situation, it is not compatible with the common understanding of justice.
