Abstract

Gambling has been criminalized in Iran, and consequently all participants in the crime are considered legal criminals, but in the Iranian criminal system, online gambling victims are not recognized and supported by them. Compared to the creators of online gambling sites, gamblers are petty criminals who tend to gamble for some reason and are also the victims of the crime. This study aimed to investigate the mechanisms supporting the victims of online gambling in Iranian and British law and seeks to answer the question of whether Iranian criminal law has the necessary capacities to deal with online gambling crime. By reviewing the laws related to online gambling in both countries, it is concluded that Iranian and UK legislators have criminalized and punished sensitive cases mainly to control online gambling and have not foreseen specific legal measures to prevent the spread of gambling. This article for the first time analyzes the ways to combat online gambling in Iranian and British criminal law using descriptive methods. In this regard, in addition to the analysis of relevant articles in Iranian and British law, strengths and weaknesses of existing laws and proposed solutions to deal with this crime have also been investigated.
