Transformative Challenges and Creative Solutions Regarding Aiding and Abetting and Participation in International Crimes Faced by the International Criminal Court

Abstract
This research examines the legal, judicial, and technical challenges in prosecuting aiding and abetting and participation in international crimes. In international criminal law, aiding and abetting and participation play vital roles through which individuals and entities assist in the commission of crimes. The International Criminal Court, referencing the Rome Statute, particularly Article 25, seeks to address the criminal responsibility of aiders and abettors and participants. The primary objective of this research is to identify the existing challenges in judicial procedures and to present innovative solutions for enhancing the Court's effectiveness in prosecuting such individuals; to achieve this objective, an analytical method was employed, and the case of Anthony Nguéjolo Chaba, a militia commander in the Democratic Republic of the Congo, has been analyzed as an example. The findings of the research indicate that ambiguities in defining aiding and abetting and participation, difficulties in proving criminal intent, and the demarcation of roles are among the key challenges. Furthermore, obstacles to international cooperation and legal disparities among countries impact the prosecution process. This research presents solutions including legal reforms in the Rome Statute, the use of novel technologies such as blockchain and artificial intelligence, and the establishment of digital courts as a framework for introducing transparency and streamlining judicial processes. Ultimately, these measures will assist in strengthening the ICC in realizing justice and preventing the recurrence of international crimes.
