چکیده
حمایت ویژه از کودکان در کنار اصل عام حمایت از غیر نظامیان در مخاصمات مسلحانه، در چهارچوب حقوق بین‌الملل عام، زمینه طرح مسئولیت کیفری را برای ناقضین این حقوق عرفی ـ معاهده‌ای فراهم کرده است. علاوه بر حمایت عام و ویژه، نهادهای بین‌المللی نقض حقوق شش گانه را «نقض فاحش» قلمداد کرده‌اند. شناخت گستره و مفهوم این موارد در عرف و کنوانسیون‌های بین‌المللی، در پرتو صلاحیت دیوان کیفری بین‌المللی، به حمایت حداکثری از کودکان در زمان مخاصمات منجر می‌شود. این حقوق علاوه بر حفاظت از جان ـ اعم از منع قتل و معلول‌سازی و ربودن و خشونت جنسی ـ به منع استفاده از کودک‌سرباز، حفاظت از محیط آموزشی کودکان و تسهیل دستیابی به کمک‌های بشردوستانه نیز می پردازد. این موارد نه تنها به‌صورت عرف بین‌المللی پذیرفته شده، بلکه در کنوانسیون‌های متعدد به‌ویژه اساسنامه رم، مورد تأکید قرار گرفته است، به‌گونه‌ای که امروزه در زمره تعهدات عام‌الشمول و الزام‌آور کشورها قرار دارد. نقض هر یک از موارد شش گانه، تحت عناوین سه گانه نسل‌زدایی، ضد بشریت و جنایت جنگی، قابلیت طرح دعوای کیفری در سطح بین‌المللی را دارد.

Special protection for children, alongside the general principle of protecting civilians in armed conflicts, within the framework of general international law, has provided the grounds for establishing criminal responsibility for violators of these customary-treaty rights. In addition to general and special protection, international institutions have considered the violation of the six rights as a "grave breach." Understanding the scope and conception of these cases in international customs and conventions, in light of the jurisdiction of the International Criminal Court, leads to the maximum protection of children during conflicts. These rights, in addition to protecting life- including the prohibition of killing, maiming, abduction, and sexual violence- also address the prohibition of using child soldiers, the protection of children's educational environment, and facilitating access to humanitarian aid. These matters have not only been accepted as international custom but have also been emphasized in numerous conventions, particularly the Rome Statute, to such an extent that they now constitute peremptory and binding obligations upon states. The violation of any of the six cases, under the three categories of genocide, crimes against humanity, and war crimes, can form the basis for initiating criminal proceedings at the international level.
